5. BINDING INDIVIDUAL ARBITRATION

PLEASE READ THIS SECTION CAREFULLY—IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Last Update to Section 5: June 27, 2017

Purpose.  This Binding Individual Arbitration Section governs all Disputes between you and any DMMAWG Entity. The term “Disputes” is to be given the broadest possible meaning that will be enforced and means any dispute, claim, or controversy of any kind between you and any of the DMMAWG Entities that arise out of or in any way relate to (1) your access to the Website and/or the Application(s); (2) your use of the Website and/or the Application(s); (3) the provision of content, services, and/or products on or through the Website, the Application(s) and/or the Service; (4) any product or service provided by or purchased from an independently owned and operated Dublin Medical Massage & Wellness Group franchised location; and/or (5) this Agreement, including the validity, enforceability or scope of this Binding Individual Arbitration Section (with the exception of the Class Action Waiver clause below), whether based in contract, statute, regulation, ordinance, tort (including, but not limited to, fraud, misrepresentation, fraudulent inducement, or negligence), or any other legal or equitable theory. The term “Disputes” includes claims that arose or accrued before you assented to this Agreement. If you have a Dispute with any DMMAWG Entity that cannot be resolved through negotiation within the time frame described in the “Notice of Dispute” clause below, you and the DMMAWG Entity with which you have a Dispute agree to seek resolution of the Dispute only through arbitration of that Dispute in accordance with the terms of this Section, and not litigate any Dispute in court, except for those matters listed in the Exclusions from Arbitration clause. Arbitration means that the Dispute will be resolved by a neutral arbitrator instead of in a court by a judge or jury.

Exclusions from Arbitration.  You AND THE DMMAWG Entities AGREE THAT the ONLY DISPUTES NOT COVERED BY THIS SECTION ARE (1) CLAIMS REGARDING the INFRINGEMENT, PROTECTION OR VALIDITY OF YOUR OR DMMAWG, LLC’S TRADE SECRETS, COPYRIGHT, TRADEMARK OR PATENT RIGHTS AND (2) CLAIMS YOU choose to pursue in small claims court where jurisdiction and venue over DMMAWG, LLC and you otherwise qualifies for such small claims court and where your claim does not include a request for any type of equitable relief.

Right to Opt-Out of Binding Arbitration and Class Action Waiver Within 30 Days. You have the right to opt-out and not be bound by this arbitration provision by sending written notice of your decision to opt-out to DMMAWG, LLC at This email address is being protected from spambots. You need JavaScript enabled to view it. . The written notice must be postmarked or emailed within thirty (30) days of the later of the date noted in the “Last Update to Section 5” or your initial log in to the Website, the Mobile Application or the In-Store Application.  Your written notification must include: (1) your name, (2) your physical postal address, and (3) a clear statement that you do not wish to resolve disputes with any DMMAWG Entity through arbitration. Otherwise you shall be bound to arbitrate any disputes, claims, or controversies in accordance with the terms of this Section. If you opt-out of this arbitration provision, the DMMAWG Entities also will not be bound by it. If you do not affirmatively elect to opt out as described above, your use of the Website, the Application(s) and/or any Service will be deemed to be your irrevocable acceptance of this Agreement and any changes/updates to this Section.

Notice of Dispute. IF YOU HAVE A DISPUTE WITH ANY DMMAWG Entity, YOU MUST FIRST SEND WRITTEN NOTICE OF THE NATURE OF THE DISPUTE TO This email address is being protected from spambots. You need JavaScript enabled to view it. TO GIVE THE DMMAWG Entity WITH WHICH YOU HAVE A DISPUTE THE OPPORTUNITY TO RESOLVE THE DISPUTE INFORMALLY THROUGH NEGOTIATION. You agree to negotiate resolution of the Dispute in good faith for no less than sixty (60) days after you provide notice of the Dispute. If the DMMAWG Entity with which you have a Dispute does not resolve your Dispute within sixty (60) days from receipt of written notice of the Dispute, you or the DMMAWG Entity with which you have a Dispute may pursue your claim in arbitration pursuant to the terms in this Section.

Class Action Waiver. PLEASE READ THIS SECTION CAREFULLY—IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS. Any disputes, claims or controversies, whether in arbitration or court, will be conducted only on an individual basis and not on behalf of, or as part of, any purported class, consolidated, representative or private attorney general proceeding. You further agree that you shall not participate in any class, consolidated, representative or private attorney general proceeding (existing or future) brought by any third party involving a Dispute. If any court or arbitrator determines that the class action waiver set forth in this paragraph is void or unenforceable for any reason or that arbitration can proceed on a class basis, then the disputes, claims or controversies will not be subject to arbitration and must be litigated. The terms of this provision will be binding on you, your heirs, successors, and assigns.

Initiation of Arbitration Proceeding/Selection of Arbitrator. If you or the DMMAWG Entity with which you have a Dispute elect(s) to resolve your Dispute through arbitration, the party initiating the arbitration proceeding must initiate it with JAMS, http://www.jamsadr.com. The terms of this Section govern in the event they conflict with the relevant JAMS rules described below.

Arbitration Procedures. Because the Website, the Applications and any Service involve interstate commerce, the Federal Arbitration Act (“FAA”) governs the arbitrability of all Disputes. The arbitration shall be conducted by a single arbitrator. Except as otherwise provided in this Section, the arbitration shall be governed by the rules set forth in this Agreement and (1) for claims of less than $75,000, the arbitration shall be governed by the JAMS Streamlined Arbitration Rules and Procedures that are in effect at the time the arbitration is initiated; and (2) for claims over $75,000, the arbitration shall be governed by the JAMS Comprehensive Arbitration Rules and Procedures that are in effect at the time the arbitration is initiated (JAMS rules are available at http://www.jamsadr.com/ or by calling JAMS at 1-800-352-5267).

DMMAWG, LLC shall bear the cost of any arbitration filing fees and arbitration fees for claims of up to $75,000, unless the arbitrator finds the arbitration to be frivolous. You are responsible for all other additional costs that you may incur in connection with the arbitration including, but not limited to attorney’s fees and expert witness costs unless DMMAWG, LLC is otherwise specifically required to pay such fees under applicable law. For claims that total more than $75,000, the JAMS Rules will govern payment of filing fees and arbitration fees. The decision of the arbitrator will be in writing and binding and conclusive on the DMMAWG Entities and you, and judgement to enforce the decision may be entered by any court of competent jurisdiction. Dispositive motions, including without limitation, motions to dismiss and motions for summary judgement will be allowed in the arbitration. The arbitrator must follow this Agreement and can award the same damages and relief as a court, including injunctive or other equitable relief and attorney’s fees and expert witness costs. The DMMAWG Entities and you understand that, absent this mandatory arbitration provision, the DMMAWG Entities and you would have the right to sue in court and have a jury trial. The DMMAWG Entities and you further understand that, in some instances, the costs of arbitration could exceed the costs of litigation and the right to discovery may be more limited in arbitration than in court.

If your claim is solely for monetary relief of $10,000 or less, and does not include a request for any type of equitable remedy, the arbitration will be conducted solely based on documents submitted to the arbitrator, through a telephonic hearing, or by an in-person hearing under the JAMS Streamlined Arbitration Rules and Procedures that are in effect at the time the arbitration is initiated.

Confidentiality of Arbitration Proceedings. Arbitration proceedings conducted pursuant to this Section 5 shall be strictly confidential. The fact that an arbitration exists or is proceeding, the nature of the Dispute, all documents exchanged in connection with the arbitration, all testimony (including transcripts of testimony, if any) that is given in the arbitration proceeding, and any arbitration award shall remain confidential. The only exceptions to this confidentiality provision are disclosures reasonably necessary to confirm or vacate an arbitration award, a judicial challenge to an arbitration award or its enforcement, or disclosure that is required by operation of law or court order; provided, however, that this Paragraph shall not prevent the disclosure of such information (1) as may be required to your legal and financial advisors and independent accountants; (2) as may be required to any DMMAWG Entity’s (a) legal, financial and other professional advisors, regulators, rating agencies, independent accountants, analysts, agents, and/or directors, (b) shareholders and/or affiliates and their respective officers, directors and legal, financial and other professional advisors, and/or (c) existing or potential insurers or reinsurers, existing or potential investors, existing or potential lenders, or existing or potential purchasers; and/or (3) as otherwise required to comply with any applicable law or regulation.

Location of Arbitration. You or the DMMAWG Entity with which you have a Dispute may initiate arbitration in either Franklin County, Ohio or the United States county in which you reside. In the event that you select the county of your United States residence, the DMMAWG Entity with which you have a Dispute may transfer the arbitration to Franklin County, Ohio in the event that it agrees to pay any additional fees or costs you incur as a result of the change in the arbitration location as determined by the arbitrator.

Severability. If any clause within this Section (other than the Class Action Waiver clause above) is found to be illegal or unenforceable, that specific clause will be severed from this Section, and the remainder of this Section will be given full force and effect. If the Class Action Waiver clause is found to be illegal or unenforceable, this entire Section will be unenforceable, and the Dispute will be decided by a court and you and the DMMAWG Entity with which you have a dispute each agree to waive in that instance, to the fullest extent allowed by law, any trial by jury.

Continuation.  This Section shall survive any termination of this Agreement or the provision of any Service to you.

6. GOVERNING LAW AND JURISDICTION

THE PARTIES AGREE THAT THE LAWS OF THE STATE OF Ohio, WITHOUT REGARD TO ITS CONFLICT OF LAW RULES, GOVERN THIS AGREEMENT AND ANY DISPUTES BETWEEN YOU AND any DMMAWG Entities. ANY DISPUTE NOT SUBJECT TO ARBITRATION WILL BE LITIGATED exclusively BY EITHER PARTY IN A COURT OF COMPETENT JURISDICTION IN EITHER THE SUPERIOR COURT OF THE STATE OF Ohio IN AND FOR THE COUNTY OF Franklin OR IN the UNITED STATES DISTRICT COURT FOR THE DISTRICT OF Ohio.

We appreciate and embrace that massage is relaxing and soothing. However, we are not a spa. We are a source of Medical and Therapeutic Treatments, and our practitioners will customize a plan that will address your specific needs in the most professional and beneficial manner possible. Please continue reading to explore the many benefits of Therapeutic Massage.

Benefits of Therapeutic Medical Massage

Centuries of global massage practices have brought about wide acceptance to the medical applications that exist today. Hospitals, eldercare facilities, mental healthcare practitioners, professional athletic associations, and so many more all recognize the impressive array of physical, mental, and emotional benefits that coincide with receiving massage.  The massage response includes a greater sense of calm, perspective and clarity as specific physiological and chemical changes course through the system creating profound effects.

Massage reduces the effects of stress.

Primary Care Physicians see many patients with stress related complaints such as headaches, neck pain, eyestrain, poor concentration, anxiety, depression, irritability, anger, high blood pressure, heart disease, ulcers, as well as physical and emotional exhaustion.

Massage therapy activates your body’s nervous system. When your body’s parasympathetic nervous system is activated, it counteracts your body’s negative response to stress, relaxes muscle tension and allows your heart rate, blood pressure and circulation to return to normal.

Massage Therapy also helps you become more aware of your body and unconsciously held tension. As you become aware of your body, you will begin to recognize tension building and you can consciously release it before it has a negative effect on your body.

Massage for Chronic Pain.

Massage therapy can temporarily block chronic pain signals from reaching the brain. It stimulates endorphins (the body’s natural painkiller) into the brain and nervous system to reduce the feeling of pain and discomfort.

MASSAGE CAN IMPROVE NERVE FUNCTION.

Contracted muscles can press on or pinch your nerves causing tingling, numbness, or pain.  Massage therapy relaxes these contracted muscles to relieve the compression on your nerves.  Sensory receptors in the skin and muscles wake up and bring new awareness to areas that have felt cut off by chronic tension patterns.

MASSAGE STRENGTHENS THE IMMUNE SYSTEM.

The lymphatic system is a major factor in your body's battle to ward off infection and heal injuries.  The lymphatic flow can be very sluggish.  Massage therapy not only improves the circulation of blood and its nutrients, but also increases the circulation of lymph in your lymphatic system thus helping your body to fight off infection and speed your recovery from illness or injury.

MASSAGE RELAXES TENSE MUSCLES.

Muscles can become tight and ineffective for many reasons. Stress, Injury, poor circulation, overuse and misuse can all cause pain and discomfort as well as restrict your normal range of motion. Massage therapy stretches and loosens tight muscles and connective tissue, breaking down and preventing further formation of adhesion, increasing range of motion and reducing the dangers of fibrosis (process by which inflamed tissue becomes scarred).

MASSAGE INCREASES BLOOD CIRCULATION.

Like a sponge that has been squeezed, a tight muscle cannot hold much fluid nor can it allow much fluid to pass through it.  This decreases your circulation and increases the strain placed on your heart.  This can leave you feeling fatigued and sore, reducing your energy.

Massage therapy releases contracted muscle and pushes venous blood towards the heart, thus easing the strain on your heart.  This increase in circulation brings nutrients and oxygen to your cells and also carries away metabolic waste products that can make you feel listless and drained.

REMEMBER, THIS IS THE ONLY BODY YOU WILL GET.  TAKE CARE OF IT!

What to Expect

Upon arrival you will be part of a thorough and thoughtful conversation that fully addresses your condition, needs, treatment and outcomes.  Once a plan is in place, your therapist will leave the treatment room to allow you to fully disrobe and get onto the table under covers.  This should be at your comfort level at all times.  Should you choose to leave undergarments on, simply inform your therapist who will honor your wishes.  It is worth noting that some treatments rely on a degree of friction or glide that can be somewhat impeded by clothing, but the level of ‘undress’ is entirely your choice.  You will, at all times, be fully draped.  Only the area of the body being worked on will be uncovered.  The exception to this is if you and your therapist will be including Positional Release or stretching exercises—you will be asked to bring appropriate workout clothing (i.e., yoga or sweat pants, sports bra, etc.).

Please remember, this is your time and our goal is to customize your experience just for you---is the room too hot or too cold?  Do you need a pillow or a bolster for under your knees? Specific music or silence?  Do you want to chat, or not at all?  Communicate your preferences to your therapist, and he or she will make every effort to accommodate you and make your experience as positive and beneficial as possible.

At the end of your session, your therapist will leave you to dress.  Before you depart, you will once again have a conversation about any ongoing stretches, exercises, or follow-up treatments.

Swedish Massage

Is the most common and familiar type of massage. It varies from light touch with long relaxing strokes to vigorous and invigorating. The five basic strokes are Effleurage (sliding and gliding), Petrissage (kneading), Tapotement (rhythmic tapping), Friction, and Vibration (shaking and rocking). Swedish Massage uses applied lubrication (lotion, oil, cream or other) to create the appropriate pressure/grip for maximum effectiveness. Most other forms of massage include some Swedish Massage to increase release and relaxation.

ASHIATSU BAREFOOT MASSAGE

Is a technique where the therapist uses their feet and body weight to administer broad, deep strokes, in combination with compression and mobility work for an extremely therapeutic and relaxing experience.

Craniosacral Therapy

Craniosacral therapy (CST) is a gentle method of evaluating the membranes and fluid that surround and protect the brain and spinal cord. The therapist’s hands ‘listen’ to the body’s unique and natural rhythm and then with gentle manipulation helps to relieve pain and dysfunction that interferes with the optimal function of the Central Nervous System. CST does not approach issues or complaints symptomatically, it looks at and treats the body as a ‘whole’ where everything is inter-connected.

Myofascial Release

The fascia is a thin, tough layer that wraps around, connects, and supports the muscles. Over time, and certainly with trauma, there becomes a lack of elasticity and fluidity that can be evidenced by the loss of flexibility and chronic pain. Myofascial Release uses gentle sustained pressure to strengthen, relax, and restore range of motion.

Neuromuscular Re-Education

Evolving from Orthopedic massage, Neuromuscular Massage is a specialized combination of deep tissue massage, pressure and friction that seeks to restore normal movement patterns and balance. It promotes healing and recovery from both acute and chronic pain issues. This form of treatment is often paired with Positional Release Therapy, specific stretching exercises, and other bodywork modalities to maximize its effectiveness.

Polarity therapy

Polarity is a system of treatment often utilized in partnership with other forms of therapy. It is intended to restore a balanced distribution of the body’s energies. It incorporates bodywork, food choices, exercise, and life style changes as part of an integrated approach to optimal well-being.

Deep Tissue Massage (DTM)

Not all therapeutic massage is deep tissue massage. In DTM firm pressure and slow strokes are used to reach the fascia, the connective tissue surrounding the muscles. It can increase circulation and reduce inflammation. It is frequently used for chronic pain and relieving adhesions/scar tissue. It is extremely advantageous in the treatment of repetitive stress injuries. When combined with other modalities of medical massage, it is especially beneficial in remediating the effects of fibromyalgia, plantar fasciitis, and hyper-tension.

Kinesiology / Kinesiology Taping

The name itself defines the practice—the study of movement. A medical massage therapist is highly skilled in utilizing Kinesiology as a diagnostic tool to more accurately assess the appropriate course of treatment. Muscles, tendons, ligaments, and bones all work in connection and in concert—chronic or acute foot pain may be generated from the hip, or issues in the hand may originate in the neck, etc. Kinesiology Taping offers support and stability to the area of treatment without restricting motion. It can prolong the beneficial aspects of manipulation/massage. Special tape is used in the healing of specific injuries or areas of concern. It can, and is often used as a preventative measure.

Manual Lymphatic Drainage

The Lymphatic System works to eliminate waste/toxins in the body. A build-up or retention of fluids in the lymph system can be caused by numerous things, but most often can be traced to a trauma or as the result of post-surgical issues, especially where cancer is part of the equation. Toxins that build in the system are attributable to food, allergies, alcohol, environmental issues, and medicines. An over-burdened lymph system is an over-whelmed immune system. The treatment consists of gentle stroking and light tapping. It is most effective in repeated sessions over several concurrent days.

Cupping

Cupping is an ancient practice that has been used extensively in Asian, Egyptian, and Middle Eastern countries, and has in recent years become widely accepted around the globe. The cups may be made of glass, ceramic, bamboo, or silicone. The procedure may be done wet or dry with varying degrees of suction and usually lasts between 5 – 15 minutes. Each treatment and person is unique. It is not uncommon for there to be a temporary discoloration or reddening at the site. The discoloration may last for several days and is rarely cause for concern. In addition to its usage for muscle tension, inflammation, and relaxation, cupping can be effective in addressing symptoms of cold, flu, and allergy.
